PRE-CONTRACTUAL INFORMATION FORM
ARTICLE 1 – PARTIES
This
Pre-Contractual Information Form (“Form”) is prepared between the buyer (“Buyer”)
listed below and the seller (“Seller”).
This Form is
related to the sales transactions conducted via the website www.40by1.com (“Website”),
owned by Hazel AYDIN BAŞAR (“Seller”), in accordance with the Law No. 6502 on
the Protection of Consumers and the Regulation on Distance Contracts. The
purpose of the Form is to inform the Buyer within the framework of the
purchasing relationship to be established between the Buyer and the Seller.

The main
features of the product are as described on the Website. Prices announced on
the Website are valid until they are updated. In the event prices are announced
for a limited period, the relevant prices are valid until the end of the stated
period. The price of the product for sale, along with shipping and additional
charges, is displayed in the table above.
ARTICLE 5 – GENERAL TERMS
5.1 This Form is an integral
part of the Distance Sales Agreement. Matters not covered in this Form shall be
governed by the terms of the Distance Sales Agreement.
5.2 For the product covered by this Form to be delivered to the Buyer or
the person designated by the Buyer, the pre-contractual information must be
electronically approved by the Buyer, and the sales price must be paid by the
Buyer. If the product price is not paid or canceled in bank records for any
reason, the Seller is considered relieved of its obligation to deliver the
product.
5.3 Unless explicitly stated otherwise, delivery costs (e.g., shipping
charges) are borne by the Buyer. Depending on campaigns announced on the
Website, the Seller may decide not to charge the Buyer for all or part of the
delivery costs.
5.4 Upon approval of this Form and the Distance Sales Agreement, the
fees and costs outlined in Article 5 shall be collected via the selected
payment method.
5.5 The Seller shall dispatch the product subject to the order to the
Buyer or the person/institution at the address specified by the Buyer no later
than 30 (thirty) days from the date the order was transmitted. If delivery
cannot be made within this period, the Buyer may terminate the Distance Sales
Agreement.
5.6 The Seller may, with prior notification to the Buyer and the Buyer’s
explicit consent, supply a product of equal quality and price to the product
subject to the Distance Sales Agreement, provided this occurs before the
performance period expires.
5.7 If the Buyer or someone designated by the Buyer is not present at
the delivery address at the time of delivery, the Seller is deemed to have
fulfilled its obligation in full. The Buyer is responsible for contacting the
courier company to arrange for delivery. If the product is to be delivered to a
third party or institution, the Seller is not responsible for the
non-acceptance or absence of this party. In such cases, the Buyer assumes
responsibility for any delays or additional charges.
